Terms of service

Welcome to Homes District. By using this platform, you agree to the terms below. We tried to write these in plain language — please read them. Section 17 contains an arbitration clause and class-action waiver that affects your legal rights.

1. What Homes District is — and is not

What we ARE

  • A technology platform and online listing venue
  • A place to publish, search, and respond to property listings
  • A messaging tool to connect buyers and sellers directly
  • A platform where listing and browsing is accessible to all users

What we are NOT

  • A licensed real estate broker or agent
  • A party to any transaction or contract
  • A verifier of listing accuracy or user identity
  • A provider of real estate, legal, or financial advice

All listing information — price, square footage, photos, condition, descriptions — is submitted by users and is not verified, endorsed, or warranted by Homes District. All transactions are directly between buyers and sellers. Homes District facilitates discovery and communication only.

Homes District's fees are for advertising and platform-access services only. They are never contingent on the sale, rental, or financing of any property, and Homes District does not collect commissions from transactions (NY RPL § 440 et seq.).

The calculators on the Platform (mortgage, BRRRR, fix-and-flip, deal analyzer) are mathematical estimation tools only. Results are not financial, investment, tax, or legal advice. Consult licensed professionals before making financial decisions.

2. Acceptance and eligibility

By accessing Homes District, creating an account, submitting a listing, or using any feature, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

You must be at least 18 years old and have the legal capacity to enter binding contracts. If you use the Platform on behalf of a business, you represent that you have authority to bind that entity.

You consent to transact electronically. Your electronic acceptance has the same legal effect as a handwritten signature under the federal E-SIGN Act (15 U.S.C. § 7001).

3. User accounts

You must create an account to list a property, send messages, or save listings. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@homesdistrict.com if you suspect unauthorized access.

You may not create more than one account per person or transfer your account without our written consent.

4. Listing rules and seller obligations

By submitting a listing, you represent and warrant that: (a) you are the property owner or are authorized by the owner to list it; (b) all information is accurate and not misleading; (c) photos are of the actual property and you have rights to use them; (d) the listing complies with all applicable laws; and (e) you are solely responsible for the accuracy and legal compliance of the listing.

You may not submit listings that contain false information, advertise a property you have no authority to list, include discriminatory language (see Section 5), or duplicate an existing listing for the same property.

All listings require admin approval before going live. Homes District may approve, reject, or remove any listing at any time without notice.

Property information and figures

Listing details — including property taxes, lot size, square footage, year built, room counts, and any other figure shown on a listing — are supplied by the person who created the listing. Where Homes District pre-fills a figure from a public record as a convenience, the person creating the listing is asked to confirm or correct it before the listing is published, and the confirmed figure is the one shown.

Homes District does not verify these figures, does not guarantee their accuracy or completeness, and makes no representation that any figure is current. Public records may be out of date, may not reflect exemptions, abatements, assessments, or changes that apply to a particular owner or to a future owner, and may change from year to year. Nothing shown on a listing is a substitute for your own review of the public record, a tax or title search, or advice from a qualified professional. Section 13 applies.

Seller disclosure obligations (NY and NJ)

New York: Sellers of 1–4 family residential property must deliver a completed Property Condition Disclosure Statement to buyers before contract (RPL § 462). As of March 20, 2024, the prior $500-credit workaround is no longer available — the full disclosure statement is required. The amended PCDA also includes mandatory flood-history and flood-zone disclosure questions.

New Jersey: All residential sellers must complete a mandatory Seller's Property Condition Disclosure Statement as required by NJ law.

Compliance with these disclosure requirements is entirely the seller's responsibility. Homes District does not collect, transmit, or verify these disclosures.

New development, condo, and co-op listings

New York law (GBL § 352-e, the Martin Act) prohibits offering or advertising cooperative, condominium, or new-construction units to the public in or from New York State until the Attorney General has issued an accepted-filing letter for the offering plan.

By submitting a condo, co-op, or new-development listing, you represent and certify that: (a) an offering plan has been filed and accepted by the NY Attorney General, or (b) the offering is otherwise legally exempt under applicable law, or (c) the listing is pre-marketing/informational only and does not constitute an offer to sell. You agree to provide the AG filing number upon request.

Homes District is not the sponsor, developer, broker, or agent for any development. Homes District does not verify AG approval status.

Pre-marketing listings: Any listing marked "coming soon," "pre-construction," or similar is for informational purposes only and is NOT an offer to sell or a solicitation of an offer to buy. No offer can be made until an offering plan is filed with and accepted by the NY Department of Law.

Open house scheduling

Open house times are set by the person who posts the listing, and the visit is arranged between that person and the buyer. Homes District publishes the time and lists the property on its open-house board; it does not host, attend, staff, or supervise any showing.

Days available. Homes District's open-house scheduler does not accept Saturday, and does not accept the hours from shortly before sunset on Friday — or on the eve of certain other days observed by the Platform's scheduling calendar — until after nightfall at the close of the period. This is the Platform's own scheduling rule, applied automatically and identically to every listing and every user. It is not a restriction on who may view, rent, or buy any property: listings remain published, searchable, and contactable every day of the week, and nothing in this rule prevents a seller and a buyer from arranging a showing privately on any day and at any time they choose. Cutoff times are computed from a single Eastern Time reference and are shown by the scheduler before a time is accepted; Homes District does not warrant that they match any particular calendar, custom, or location. Homes District does not ask, record, or act on any user's religion, and no showing arranged off the Platform is affected by this section. Nothing here is legal, religious, or professional advice.

Homes District does not verify that an open house takes place, that the property is as described, or that anyone will be present. Attendance is at your own risk, and Section 14 applies.

Photos and virtual staging

Photos must be of the actual property being listed. If you include virtually staged, digitally altered, or AI-generated images, you must clearly label them as "virtually staged" or "digitally enhanced." Presenting altered images as unaltered photography may constitute deceptive practice under NY GBL § 349 and is prohibited.

MLS photos

MLS photographs are typically owned by the photographer or the brokerage — not automatically by the listing agent or seller. If photos were originally taken for an MLS listing, confirm with your brokerage or photographer that you have written permission to use them on third-party platforms before uploading. Homes District is not responsible for unauthorized content uploaded by users. Users who upload content they do not have rights to may be held liable for copyright infringement.

Solicitation compliance (NY RPL § 442-h)

Users who contact property owners to solicit listings agree to comply with all applicable non-solicitation and cease-and-desist zone restrictions under NY RPL § 442-h and regulations promulgated thereunder. Homes District does not engage in solicitation and is not responsible for user solicitation activities.

5. Fair housing and anti-discrimination

Homes District is committed to equal housing opportunity.

All users must comply with the federal Fair Housing Act (42 U.S.C. § 3601), the NY State Human Rights Law (Executive Law § 290), the NJ Law Against Discrimination (N.J.S.A. 10:5-1), and all other applicable fair housing laws.

Federal protected classes: race, color, religion, national origin, sex, familial status, and disability.

New York additionally protects: age, marital status, military status, lawful source of income, citizenship/immigration status, and domestic-violence-victim status, among others.

New Jersey additionally protects: creed, ancestry, marital status, affectional or sexual orientation, gender identity or expression, lawful source of income (including housing vouchers), pregnancy, and military service, among others.

You agree that in any listing, message, or communication through the Platform you will NOT:

  • State, indicate, or imply any preference, limitation, or discrimination based on any protected class
  • Use language, codes, or descriptors that signal a preference for or against any protected class (e.g., "adults only," "no kids," "ideal for [religious/ethnic group] only")
  • Refuse to negotiate with or provide different terms to any person because of their protected class
  • Steer buyers or renters toward or away from areas based on demographics

Homes District will remove listings or messages that violate fair housing law and may suspend or terminate accounts, with referral to HUD, NY Division of Human Rights, or NJ Division on Civil Rights.

Homes District markets to the heimishe Orthodox Jewish community. This reflects our audience. All housing on Homes District is available to all persons regardless of protected class, and all listings and transactions must comply with fair housing law.

6. Messaging and communications

The Platform's direct messaging feature is for legitimate real estate communications only. You may not use it for spam, harassment, unsolicited marketing, or any unlawful purpose.

Wire fraud warning

Real estate wire fraud cost Americans over $275 million in 2025. Criminals impersonate buyers, sellers, agents, and title companies to redirect payment instructions. Homes District will never send you wire transfer instructions, and we do not handle deposits, down payments, or closing funds. Never wire money or send deposits based solely on instructions received through Homes District, email, or text. Always independently verify payment instructions by calling a known, trusted phone number before sending any funds. Report suspicious messages to hello@homesdistrict.com and to the FBI at ic3.gov.

Account verification is currently performed by email. Homes District does not send SMS text messages. If text messaging is introduced in the future, it will be optional, transactional, and governed by program terms added to Section 10 at that time.

Homes District may send transactional emails (listing status, new message alerts, expiry reminders). You may manage notification preferences in account settings.

Shabbos and Yom Tov: Homes District delays delivery of non-urgent notifications during Shabbos and Yom Tov as a platform feature. This delay is best-effort — it is not guaranteed, and you remain solely responsible for time-sensitive communications and any consequences of delayed notifications. Verification codes are sent immediately at all times.

Homes District does not actively monitor private messages and is not responsible for their content. However, Homes District reserves the right to review communications where required by law or to investigate reported violations.

7. Payments, promoted listings, and subscriptions

Promoted listings ($49/week)

Sellers may pay to promote a listing for enhanced visibility. Payment is processed by Cardknox/Sola Payments via their iFields iframe. Card data is entered directly into Cardknox's secure system and never transmitted to or stored by Homes District's servers.

Authorization hold flow: When you submit a promoted listing, an authorization hold is placed on your card. The charge is captured only when your listing is approved and goes live. If your listing is rejected or not approved, the hold is voided and no charge is made. Depending on your card issuer, a voided hold may take several business days to disappear from your statement. Homes District does not control issuer-side hold timelines.

Promoted listing fees are non-refundable once your listing has been approved and the charge captured, except as required by applicable law. Promotion does not guarantee specific placement, leads, inquiries, or a sale. Promotion is for a week from the date of approval and is not automatically renewed.

Subscription plans

Homes District offers optional paid subscription plans (Sapphire, Emerald, and Diamond). Subscriptions are billed on a recurring monthly basis.

Auto-renewal disclosure (required by NY GBL § 527-a): Subscription plans automatically renew at the end of each billing period unless you cancel. The renewal charge, billing frequency, and cancellation method will be clearly disclosed at the time of purchase and in your confirmation email. You may cancel at any time from the Billing page in your dashboard — cancellation takes effect at the end of the current billing period. Homes District will send a reminder email before any renewal that changes in price or terms.

No refunds on subscriptions: Subscription fees are non-refundable. If you cancel mid-period, you retain access through the end of the period you already paid for.

By authorizing payment, you confirm you are the authorized cardholder and authorize Homes District/Cardknox to charge the card for the amount displayed.

Cancelling

You may cancel any paid plan at any time, for any reason, without contacting anyone and without giving a reason. Cancel from the Billing page in your dashboard. There is no cancellation fee, no minimum term, and no notice period. Your plan stays active until the end of the billing period you have already paid for, and then stops. Cancelling a plan does not delete your account, your profile, or your listings.

Renewals, reminders, and receipts

You agree to the renewal separately. Before a recurring plan starts, Homes District shows you the price, how often it is charged, when the first renewal falls, and how to cancel — and you agree to those renewal terms as their own step, not as part of accepting these Terms. If Homes District cannot show you that, it does not start the plan.

You get a receipt you can keep. Every charge, including every renewal charge, produces an emailed receipt showing what was bought, the amount, the period it covers, and a link to cancel. Receipts also stay on the Billing page in your dashboard.

Advance notice before a long renewal. Where a plan renews for a term of six months or longer, Homes District will email you between 15 and 45 days before the renewal date, telling you the date, the amount, and how to stop it. This is in addition to the notice Homes District gives before any change in price or terms. Weekly and monthly plans do not carry this notice — you can cancel either at any time and the cancellation takes effect at the end of the period you have already paid for.

You may cancel the way you signed up. If you bought online, you can cancel online, in the same place, in the same number of steps or fewer, without speaking to anyone, without an offer or a survey standing in your way, and without giving a reason. If the Billing page is unavailable to you for any reason, emailing hello@homesdistrict.com with the word "cancel" is enough, and the cancellation takes effect from the date you sent it.

Homes District applies this section to every paid plan and every buyer, including businesses, whether or not the law requires it for that buyer.

Support — what "priority" means and does not mean

Every account on Homes District, paid or free, can contact us and will get an answer from a person.

Paid plans are placed ahead of free accounts in the support queue, and higher plans ahead of lower ones. That is an ordering rule, not a deadline. Homes District does not publish, promise, or guarantee any response time, first-reply time, or resolution time on any plan. Any internal target Homes District may use to organize its own work is for Homes District's benefit only, is not disclosed as a commitment, and creates no obligation or right of any kind. If Homes District ever offers a specific response-time commitment, it will say so in writing at the time of purchase and identify it as a commitment.

Priority support does not include a named or dedicated contact, an account manager, a phone line, out-of-hours coverage, or availability on any particular day. Homes District is a small operation and answers messages when it is working.

What a plan includes, and changes to it

The features included in each plan are the ones described on the pricing page at the time you purchase. Homes District may add, change, rename, re-tier, or remove features, and may change prices, at any time.

If Homes District materially reduces the features of a plan you are currently paying for, or raises its price, Homes District will notify you by email before the change takes effect for you, and you may cancel before it does. Continuing to pay after the effective date is acceptance of the change.

Homes District may also suspend, downgrade, or remove access to paid features if payment fails, if a chargeback is filed, or in the circumstances described in Section 16.

If Homes District removes something you already paid for

If the reason is ours, you are refunded. Where Homes District removes, suspends, or stops showing a promoted listing or a paid placement for a reason that is not your fault — including a technical failure, a change Homes District makes to a page, or Homes District discontinuing the product — Homes District will refund the unused portion of what you paid for that item, calculated pro rata from the day it stopped running. You do not need to ask.

If the reason is yours, it is not. Where Homes District removes a listing, placement, or account because of a breach of these Terms — including a listing that is inaccurate, fraudulent, not yours to list, in breach of Section 5 (fair housing), or in breach of Section 9 — no refund is due, and the fees already charged are retained. This is stated plainly so that it is not a surprise: the money is not a deposit against good behaviour, and it is not returned when a listing is taken down for cause.

Nothing in this subsection limits any refund right you have under applicable law, or your right to dispute a charge with your card issuer.

No guarantee of results

No paid plan, promoted listing, featured or sponsored placement, directory position, or any other paid product on Homes District guarantees any outcome. In particular, Homes District does not guarantee any: lead, enquiry, message, call, showing, offer, sale, rental, or closing; ranking, position, ordering, or level of visibility; number of impressions, views, or clicks; amount of traffic; or business result of any kind.

Where a paid plan describes placement — for example appearing in a rotation, a directory, or an area — that placement is subject to how many other people have bought it, how the relevant page is designed at the time, and Homes District's right to change the design of any page. Placement is shared and rotational unless the page you purchased from expressly states otherwise.

A visitor's own sort always wins. Paid position applies to the default ordering of a page. When a visitor actively chooses their own sort — by price, or any other ordering Homes District offers — results are shown in the order they asked for, and paid listings receive no boost in that view. Homes District will not override a visitor's explicit choice for a paying customer, and no paid product should be bought on the assumption that it will.

8. Intellectual property and content license

The Platform — including its design, code, calculators, logos, and original content — is owned by Homes District and protected by copyright, trademark, and other IP laws. You may not copy, reproduce, or create derivative works without written permission.

License you grant us: By submitting any content (listings, photos, text), you grant Homes District a non-exclusive, royalty-free, worldwide license to host, display, distribute, and use that content to operate and promote the Platform. This license ends when you remove the content, subject to reasonable backup retention.

Your warranties: You represent and warrant that: (a) you own or are licensed to use all content you submit; (b) your content does not infringe any third party's IP rights; and (c) you will indemnify Homes District against any claim arising from content you submit. Professional photos from MLS are often owned by the photographer or brokerage — confirm rights before uploading.

DMCA copyright takedown: If you believe content on the Platform infringes your copyright, send a notice to hello@homesdistrict.com including: (a) identification of the copyrighted work; (b) location of the infringing material; (c) your contact information; (d) a good-faith belief statement; and (e) your signature (physical or electronic). Homes District will respond under the DMCA safe harbor (17 U.S.C. § 512).

9. Prohibited conduct

You agree not to:

  • Submit false, fraudulent, or misleading listings or account information
  • Impersonate any person or entity or misrepresent your affiliation
  • Use bots, scrapers, or automated tools to access or collect data from the Platform
  • Attempt to bypass or circumvent any security feature or access control
  • Interfere with or disrupt the Platform or servers
  • Harvest other users' contact information without their consent
  • Use the Platform for any unlawful purpose
  • Engage in money laundering, fraud, or any financial crime
  • Send spam, chain messages, or unsolicited bulk communications
  • Harass, threaten, or abuse any user or Homes District staff
  • List a property without authorization from the owner
  • Post AI-generated or virtually staged photos without labeling them as such

10. Text messaging

Homes District does not currently send SMS text messages; account verification and notifications are delivered by email. If Homes District introduces text messaging, it will be optional and transactional, consent will be collected at opt-in, and full program terms (including opt-out instructions) will be added to this section before any message is sent.

11. No agency or brokerage relationship

Nothing in these Terms or your use of the Platform creates any agency, brokerage, partnership, joint venture, employment, or franchise relationship between Homes District and any user. Homes District is a neutral technology platform. All real estate negotiations, agreements, and transactions are between users directly.

Homes District does not: negotiate deals, set pricing, represent buyers or sellers, collect commissions from transactions, or act as a licensed real estate broker or agent in any jurisdiction.

12. Third-party services and affiliate disclosure

The Platform may link to or integrate third-party websites and services. Homes District is not responsible for third-party content, practices, or privacy policies.

Affiliate disclosure: The Partners & Tools page and other areas of the Platform may include links to third-party products and services. Homes District may receive compensation (referral fees or affiliate commissions) if you sign up through those links. This compensation does not affect which partners are listed. All material connections are disclosed as required by FTC guidelines (16 CFR Part 255).

RESPA notice: Some partner services (mortgage lenders, title companies) are settlement service providers under RESPA (12 U.S.C. § 2607). Homes District does not receive referral fees tied to the completion of transactions or loan originations. Partner relationships are flat-fee advertising arrangements only.

Sponsored content: Sponsored cards from lenders and other service providers appear on certain pages (such as the calculators and search results) and are always labeled as sponsored. Advertisers receive only aggregate performance counts for their ads (views and clicks) — never your identity or contact information. Your contact details reach an advertiser only if you submit them yourself through that advertiser's contact form, as described in Section 4.2 of our Privacy Policy.

Paid placement is not an endorsement

Some positions on Homes District are paid for. A listing its owner has promoted is labeled Featured. Advertising for someone other than the listing's owner is labeled Sponsored. A paid subscription may also affect where an agent or service provider appears in a directory, a rotation, or an area.

When you see one of those labels, it means one thing: that person paid for that position. It is not a recommendation, endorsement, referral, ranking, rating, award, or vetting by Homes District. It is not a statement that they are better, busier, more successful, more experienced, more honest, or more trustworthy than anyone else on or off the Platform. Homes District does not rank people by quality and does not measure it.

A higher-priced plan may allow an agent to show more information about themselves — for example how long they have been licensed, the areas they work in, or a short description they wrote. That is the agent's own information, presented by the agent. Homes District does not verify it beyond what is stated below, and showing more of it is not a judgement by Homes District about the agent.

If you advertise on Homes District

An advertiser is responsible for its own advertisement. If you buy a placement, you represent and warrant that every claim in it is accurate and not misleading, that any product, rate, or term you advertise is one you are actually prepared to offer to a reasonable number of qualified applicants who respond, and that the advertisement complies with every law that applies to you and to the product you are advertising.

Credit advertising. If you advertise a mortgage or any other consumer credit product, you are responsible for compliance with the Truth in Lending Act and Regulation Z, the Mortgage Acts and Practices rule (Regulation N), and any state licensing or advertising rule that binds you. That includes stating a rate as an annual percentage rate where Regulation Z requires it, displaying your NMLS unique identifier where your state requires it, and carrying any state licence legend your state requires — for example the New York registered-broker or licensed-banker legend. Homes District publishes what you supply; Homes District does not draft, approve, or verify your advertising copy, and displaying it is not a statement by Homes District that it complies with anything.

Rates. A rate shown in an advertisement is the advertiser's own figure as of the date shown. It is not an offer of credit, not a quote, not a commitment to lend, and not a rate Homes District has checked. Where Homes District offers a button that copies an advertised rate into one of its calculators, that is a convenience for you the visitor and the result remains an estimate produced by Homes District's calculator, not an offer by the advertiser.

Records. Homes District keeps a copy of each materially different advertisement it publishes, and of the rates and terms supplied with it, for at least twenty-four months from the last date it ran. Advertisers agree to Homes District retaining that record and to supplying, on request, the material substantiating any claim in their advertisement.

What "Verified" means

A Verified agent badge means only that Homes District checked that the person holds a real estate license that was active in the state shown at the time we checked. Nothing else.

It is not a background check, a review of complaints or disciplinary history, a check of their sales, their references, their brokerage, their insurance, or their conduct. It is not an opinion about them. Verification is not affected by what an agent pays: every plan, including the free one, is verified the same way, and paying more does not make anyone verified.

You should still check a license yourself before you rely on it — New York DOS and New Jersey DOBI both publish free public lookups.

13. Disclaimers of warranties

The platform is provided "as is" and "as available" without warranty of any kind.

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMES DISTRICT EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, AND ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Homes District does not warrant that any listing is accurately described, legally available, free of defects, or priced appropriately. All real estate transactions involve risk. You are solely responsible for your own due diligence — including independent inspection, title research, and legal review — before entering any transaction.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL HOMES DISTRICT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, EVEN IF HOMES DISTRICT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

HOMES DISTRICT'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO HOMES DISTRICT IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Homes District is not liable for: (a) the conduct or content of other users; (b) fraud, misrepresentation, or unlawful acts by any buyer, seller, landlord, or tenant; (c) any transaction between users; or (d) any third-party service linked on the Platform.

15. Indemnification

You agree to indemnify, defend, and hold harmless Homes District, its officers, directors, employees, agents, and licensors from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) any listing or content you submit; (c) your violation of these Terms; (d) your violation of any applicable law, including fair housing laws; (e) any real estate transaction you enter into through the Platform; (f) your violation of any third party's rights; or (g) any fraud or misrepresentation by you.

16. Account termination

You may close your account at any time from Settings → Account → Delete account. Deletion removes your profile and deactivates your listings. Messages and transaction records may be retained as required by law.

Homes District may suspend or terminate your account with or without notice for violation of these Terms, fair housing law, fraudulent listings, prohibited conduct, or for any other reason at Homes District's sole discretion. Termination does not affect your obligation to pay any outstanding fees.

17. Dispute resolution and binding arbitration

Important — please read carefully

This section requires binding individual arbitration for most disputes and waives your right to a jury trial or class action.

Informal resolution first. Before filing any claim, the disputing party must send written notice to the other describing the dispute and relief sought, and both parties must attempt to resolve it in good faith within 30 days. Notices to Homes District: hello@homesdistrict.com.

Binding arbitration. If unresolved, disputes will be settled by final, binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in New York County (or by video/telephone at your election).

Class action waiver. YOU AND HOMES DISTRICT WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All disputes must be brought in your individual capacity only.

Exceptions. Either party may pursue claims in small claims court or seek emergency injunctive relief in court for IP disputes or to prevent imminent harm.

Opt-out. You may opt out of arbitration by emailing hello@homesdistrict.com within 30 days of first accepting these Terms, with your name, email, and a clear opt-out statement.

Statute of limitations. Any claim must be brought within one (1) year of when you knew or should have known of the facts giving rise to the claim.

18. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in New York County, New York.

19. Changes to these terms

We may update these Terms at any time. For material changes, we will notify registered users by email and update the "Last updated" date. Continued use after the effective date constitutes acceptance. If you disagree with updated Terms, close your account and stop using the Platform.

20. General provisions

  • Entire agreement. These Terms, the Privacy Policy, and the Cookie Policy are the entire agreement between you and Homes District regarding the Platform.
  • Severability. If any provision is unenforceable, the rest remains in effect. If the class-action waiver is unenforceable, the arbitration clause is also unenforceable for that claim.
  • No waiver. Failure to enforce any provision is not a waiver of the right to enforce it later.
  • Assignment. Homes District may assign these Terms in a merger or acquisition. You may not assign your rights without our written consent.
  • Force majeure. Homes District is not liable for delays or failures caused by events beyond our reasonable control.
  • Platform availability. Homes District may modify, suspend, or discontinue any part of the Platform at any time without liability.
  • Notices. Notices to Homes District: hello@homesdistrict.com. Notices to you: the email on your account.
